1. Agreement to Terms

By accessing or using any product or service provided by 137 & Co ("we", "us", "our") through smartastrologics.com and its associated applications (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Smart Astrologics provides AI-powered astrology products, including Smart Horoscopes and Smart Tarot. Our Service uses proprietary astronomical calculations combined with artificial intelligence to generate personalized readings and insights based on your birth chart data.

3. User Accounts

To use certain features, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be at least 13 years old to create an account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or otherwise extract data from the Service by automated means
  • Resell, redistribute, or commercially exploit the Service or its outputs without our written consent
  • Impersonate another person or entity

5. Intellectual Property

The Service, including its software, design, content, and branding, is owned by 137 & Co and protected by applicable intellectual property laws. Your use of the Service does not grant you ownership of any content, code, data, or materials you may access.

Content generated for you (readings, journal entries, chat transcripts) is yours to keep, but the underlying systems, prompts, and AI models remain our property.

6. Payment Terms

Paid subscriptions are processed through LemonSqueezy, our Merchant of Record. By subscribing, you also agree to LemonSqueezy's terms of service.

  • Subscription fees are billed in advance on a recurring basis (monthly or yearly).
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then.
  • Price changes will be communicated in advance. Existing subscriptions will honor the original price for the current billing cycle.

7. Disclaimers

Astrology readings provided by the Service are for entertainment, personal insight, and self-reflection purposes only. They do not constitute professional advice of any kind — including but not limited to medical, financial, legal, or psychological advice.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or reliability of any reading or content generated by the Service.

8. Limitation of Liability

To the maximum extent permitted by law, 137 & Co shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service.

Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms, engage in abusive behavior, or for any other reason with reasonable notice. You may delete your account at any time by contacting us.

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.
